The employee must have worked for a qualifying foreign organization for one continuous year within the three years preceding their admission to the US.

The transferee must be coming to the US to work in an executive, managerial, or specialized knowledge capacity.

The US employer must have a qualifying relationship with the foreign company, such as being a parent, branch, subsidiary, or affiliate.

The employer must be doing business as an employer in the United States and at least one other country for the duration of the beneficiary's stay.

The US employer must file Form I-129, Petition for a Nonimmigrant Worker, on behalf of the employee.
