EB-3 Skilled Worker Green Card Checklist

Applicants in the professional subcategory must hold at least a U.S. bachelor’s degree or a foreign equivalent, and their job must require such a degree.

Professionals are persons who hold at least a U.S. bachelor’s or foreign equivalent degree and are a member of the professions. Their jobs require a minimum of a bachelor’s degree.

Skilled workers must demonstrate at least two years of training or work experience that is not of a temporary or seasonal nature.

Skilled workers are persons who are capable of performing skilled labor and whose job requires at least 2 years training or experience, not of a temporary or seasonal nature.

The applicant must have a permanent, full-time job offer from a U.S. employer to be eligible for the EB-3 visa category.

This category allows U.S. employers to sponsor foreign nationals for permanent, full-time positions in the United States.

The U.S. employer must file Form I-140, Immigrant Petition for Alien Workers, to initiate the EB-3 visa process for the foreign national.

Third preference petitions are filed using Form I-140, Immigrant Petition for Alien Workers.

The employer must obtain an approved labor certification from the U.S. Department of Labor, confirming that no qualified U.S. workers are available for the position.

Labor certification requires a U.S. employer to prove to the U.S. Department of Labor that no minimally qualified U.S. workers are available for the position sought by the foreign employee.
